1. Acceptance of Terms

By accessing or using the Mimarix platform ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

You must accept these Terms upon your first login to access the Service. Your continued use of the Service constitutes ongoing acceptance.

2. Description of Service

Mimarix is an AI-powered architectural floorplan generation platform that allows architects, designers, and other professionals to generate floorplans, site plans, and architectural drawings using artificial intelligence.

3. User Accounts

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must be at least 16 years of age to create an account.
  • One person or entity may not maintain more than one free account.

4. Intellectual Property & Copyright

4.1 Platform Copyright

The Mimarix platform, including its software, UI design, algorithms, AI models, documentation, and all associated intellectual property, is owned by Mimarix and protected by copyright, trademark, and other intellectual property laws.

4.2 Your Content

You retain ownership of the inputs you provide (prompts, settings, uploaded documents). By using the Service, you grant Mimarix a non-exclusive, worldwide license to process your inputs solely for the purpose of generating floorplans and improving the Service.

4.3 Generated Outputs

Floorplans and other outputs generated by the AI are licensed to you for your professional and personal use, subject to the following conditions:

  • Paid subscribers: You receive a perpetual, non-exclusive license to use, modify, and distribute generated outputs for any lawful purpose, including commercial projects.
  • Free tier users: Generated outputs are licensed for personal and educational use only. Commercial use requires a paid subscription.
  • Generated outputs must not be misrepresented as human-created without modification or professional review.

4.4 Architect Responsibility

AI-generated floorplans are design aids and starting points. The architect or licensed professional is solely responsible for:

  • Reviewing and validating all generated designs
  • Ensuring compliance with local building codes, zoning regulations, and safety standards
  • Obtaining necessary permits and approvals
  • Professional liability for final designs submitted for construction

5. Subscriptions & Billing

  • Free accounts include limited credits per month.
  • Paid plans are billed monthly or annually as selected.
  • Credits do not roll over between billing periods unless otherwise stated.
  • Failed generations automatically refund the consumed credit.
  • Refund requests for subscriptions must be made within 14 days of purchase.
  • We reserve the right to change pricing with 30 days notice.

6. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the AI model or algorithms
  • Use the Service to generate designs that violate any applicable law or regulation
  • Share your account credentials or allow unauthorized access
  • Use automated tools to scrape, crawl, or excessively consume API resources
  • Upload malicious files, viruses, or harmful content
  • Resell, sublicense, or white-label the Service without written agreement
  • Use generated floorplans in a manner that could endanger public safety

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

8. Limitation of Liability

To the maximum extent permitted by law, Mimarix shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Mimarix does not guarantee the structural integrity, code compliance, or constructability of AI-generated designs. All generated outputs are provided "as is" and require professional review.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Termination

We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or fail to pay subscription fees. Upon termination:

  • Your access to the Service will be revoked
  • You may request export of your data within 30 days
  • We may delete your data after a 30-day grace period

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Mimarix is incorporated, without regard to conflict of law provisions.
